In July 1978 I found the naked body of
a woman laying face down in a pool of
blood on the floor of the store where she
had been murdered. In an effort
to help, I rushed over lifting her shoulder
to see if she was alive. As I
lifted her lifeless body, blood gushed
from her wounds. Shocked, I let go
her shoulder which dropped into the pool
of blood on the floor, splashing
the legs of my jeans. My only thought
was to get help. I waved to passersby
in the distance but they took no notice.
I rushed home where I told my
family.
We returned to the store where police were
already in attendance. I told
them what had happened and I was
escorted to a police vehicle where I was
questioned further. I was then taken
to jail where I was questioned again,
and later locked up.
I was a juvenile at the time and law requires
that a juvenile must have
their parent or independent adult present
during questioning. This right
was denied me. I did not know my
rights, nor did my family. Prior to my
conviction, I had never been in trouble
with the law in any way, and had
always been gainfully employed.
I was later released due to insufficient
evidence and learned that another
person was strongly suspected of the crime.
However, some time later I was
taken into custody again, where I was locked
up in juvenile detention.
During my time in juvenile detention I
was told I would be released if I
admitted to the crime. This confidence
trick has cost me my freedom.
The Judge in my case was the brother of
the DA who became prosecutor at my
trial hearing, who was also in a law practice
with their father who had been
consulted by the defense. A clear
conflict of interests and contravention
of judicial ethics.
One of the State's key witnesses, who was
also the prime suspect in this
case, had prior convictions of a similar
nature. This man stood as witness
against me.
Forensic evidence available does not implicate
me. A fingerprint found on
the murder weapon was not mine. A
variety of blood, tissue, hair and
material samples were taken. None
implicated me. Tests that would have
cleared me were not done or if they were,
they were not reported. There was
no DNA test done, and hair analysis was
not done, or if it was done it did
not implicate me and therefore, not reported.
Certain protocols were not
followed. Amazingly, the State has now
"lost" the material evidence so I am
unable to conduct my own DNA tests to conclusively
prove my innocence.
The State withheld important documentation in my case for 17 years.
I will be executed,
as a juvenile,
for this murder that I did not commit.

I was sentenced to death for a
crime I was accused of at 17 years of age. I have been incarcerated
for 21 years. One half of my life. My interests are life, any
aspects of the outdoors, motorcycles, art, poetry and most of all, freedom.
