Spaniard Mora's death sentence commuted to life in new hearing

Spaniard Julio Mora walked off death row on Tuesday, when his sentence
was reduced to life in prison during a court hearing in Ft. Lauderdale,
just north of Miami.

Mora, 76, received 3 life sentences with no chance of parole from Judge
Paul Backman, who had previously sentenced him to death.

Mora received the original sentence in 1997 for a double murder, but the
Florida Supreme Court overturned the punishment based on a legal
technicality and ordered a resentencing.

At the Tuesday hearing's close, prosecutors refused to ask for the death
penalty due to the defendant's advanced age and apparently unstable
mental condition, Mora's public defender Kenneth Malnik told EFE.

District attorney Tim Donnelli refused to pursue the death penalty
against Mora because the wait on death row is approximately 14 years,
which means he would be executed at about the age of 90.

Mora, attired in a prison uniform and handcuffed to the wheelchair in
which he had arrived at court, listened impassively to the judge's
ruling.

Earlier, when Backman asked if he had anything to say before hearing the
sentence, Mora called both judge and public defender a couple of
"scoundrels" and said he had nothing to say.

Spain's Consul General in Miami, Javier Vallaure, who attended the
hearing and whom Mora greeted at session's end with a smile and a wave,
expressed the Spanish government's satisfaction for the relatively happy
ending to the prisoner's case, now that his life has been spared.

The new sentence may be appealed within the next 30 days, although Malnik
said he will probably not resort to such a measure.

Mora, though, claims he is innocent and plans to appeal his 1997 sentence
in federal court.

He was found guilty of the 1994 murder in Ft. Lauderdale of his former
boss, Clarence Rudolph, and attorney Karen Starr Marx, who was 4 months
pregnant.

The slayings occurred during a preliminary hearing in a lawsuit Mora had
filed for having been fired as a computer professor at a retirement home.

Mora's involvement in "the shootout" was self-defense, since Rudolph and
a bodyguard were about to shoot him and because, that same day, he had
been poisoned "as a result of terrorist actions committed by my former
boss," he told EFE in a jailhouse interview last year.

Rudolph and "other cronies paid by Islamic Jihad" had been trying to gas
his apartment, which had made Mora have to sleep with a gas mask on and
extractor fans blowing, he said.

Mora will either remain in the state penitentiary in the northern Florida
city of Starke or be transferred to a jail in the southern part of the
state for medical treatment, Donnelli said.

Even though my main degrees are in medicine, cirugie and molecular biology, I also graduated as a civil and electrical engineer, as part of the curriculum to be genetic engineer; main universities, Central De Madrid, now University Complutensis, Madrid Spain; Sorbonne, Paris France, but also from Venezuela, Chile & Peru.  30 years ago you could not say you were a Genetic Engineer since people associated it to Frankenstein (monster builder).
