    APPEAL FOR HELP FROM AN INNOCENT MAN ON DEATH ROW, FLORIDA
    
  . . . The following information was provided by the supporters of James Guzman . . .

On 12 August 1991, a while male by the name of David Colvin was found  murdered in his motel room. His body was discovered by the motel's maintenance man, at approximately 9.00am.  The maintenance man then contacted the police, who arrived and taped off the crime scene at approximately 9.37am.

At the crime scene, a medical examiner by the name of Dr Terrence Steiner, after examining the crime scene and the victim's body, established the time of death to have occurred between 24-36 hours prior to the body being found.  Therefore, according to this information, the victim was murdered,  between Saturday 10 August at 9pm and Sunday 11 August at 9am.

On the same date that the victim was found murdered in his motel room, two witnesses called Curtis Wallace and Anthony Lee, told the investigating officers that they last saw the victim alive between 9pm-12 midnight on 10 August 1991.

[According to this information from the two eye-witnesses and the medical examiner, the victim could not have been murdered any time sooner than 9pm on 10 August 1991].

On Thursday 15 August 1991, a detective by the name of Wright received information from a confidential informant, that he had overheard a conversation that Curtis Wallace had killed a man at a motel, and that a ring and a large amount of cash was in Wallace's possession after the man was murdered.

The confidential informant further advised that if the detectives were to contact Wallace's friend Anthony Lee, that they might obtain additional information from him.

On Tuesday 29 August 1991, contact was made with Anthony Lee, who gave a sworn statement that Curtis Wallace, his friend, had told Lee that he [Wallace] was the one who murdered the victim David Colvin. Furthermore, Lee stated that on 10 August 1991, he saw Wallace coming out of the victim's room between 9pm-12 midnight, with a long taped object in his hand, that looked like a stick. Lee further stated that he looked into the room and saw the victim covered in blood and that a television set was on.

According to this information, Curtis Wallace murdered David Colvin. However, Wallace had left the State of Florida, where this incident had occurred, and could not be found.

Four months later, the detectives not being able to find Curtis Wallace, had arrested, tried and convicted James Guzman for the murder that Wallace was accused of having committed.

There was no eye witnesses or direct evidence linking Guzman to the murder of David Colvin. The only evidence that the State presented on which Guzman was found guilty was the testimony of a prositute called Martha E. Cronin, who stated that Guzman had told her that he committed the murder on 10 August 1991 at approximately 3pm.

Guzman on his defense, presented a letter which Cronin admitted writing to Guzman, in which she wrote, that if she could not have Guzman for herself, she would make sure that no other woman ever would.

Guzman also presented to his defense, a witness who stated that Cronin told him that she lied on Guzman so that she could avoid going to jail for an active warrant for her arrest.

Guzman also presented the testimony of a Judge who testified that Cronin had aided and abetted perjury in his court room.

Guzman also presented the testimony of the State's own medical examiner who established the time of death to be 24-36 hours prior to the body being found, and the testimony of both Anthony Lee and Curtis Wallace, who stated that they both saw the victim alive on 10 August 1991 at approximately 9pm - 12 midnight. In addition to Lee's sworn statement implicating Wallace.

Furthermore, Guzman pointed out that he could not have murdered David Colvin at 3pm on 10 August, as stated by Cronin, because according to Anthony Lee, Curtis Wallace and the medical examiner, David Colvin was seen alive at 9pm - 12 midnight on 10 August 1991.

All of the above information is supported by legal documentation and the record, and undisputed by the State. Therefore standing as facts.

According to Florida laws and the justice system, the State must prove its case beyond any reasonable doubt, before a man can be found guilty of a capital murder. And if such a thing as reasonable doubt exists, or a miscarriage of justice, I know of no better case than this one to prove just that!
