RESOLUTION IN THE MATTER OF GARY GRAHAM (SHAKA SANKOFA)

Whereas  ____________________________ has heen apprised of the case of Gary Graham, now known as Shaka Sankofa, a 35 year old African American prisoner in Texas under sentence of death for the alleged murder of a white man committed when he was a juvenile, aged seventeen, based on the testimony of single eyewitness; and whereas there appears to be evidence which could prove that he was denied a fair trial and may be innocent of the crime for which he is sentenced to death; and whereas the legal system has failed to provide adequate review of all of the relevant evidence in this capital case based on procedural grounds; and whereas the execution of a possibly innocent man is incompatible with fundamental principles of due process and fairness and is not an acceptable form of punishment; and whereas international and humanitarian principles of law prohibit the execution of juvenile offenders and gaurantee fundamental and inalienable human rights to all human beings regardless of race, national origin, class and religion.
 

IT IS HEREBY RESOLVED that  ___________________________ would like to express its concern that complete fairness and equality is accorded to Shaka Sankofa ; that public officials carry out their mandated duties and ensure that Shaka Sankofa is provided access to the legal system and impartial and constitutionally sound judicial review as guaranteed under international law and the United States Constitution; that Shaka Sankofa be granted a new trial ; and that no execution date be set in his case ; and that a moratorium on capital punishment be instituted while thorough and in depth study of the administration and use of the death penalty in the United States is undertaken.
