Florida Prisoners Need Immediate Help
     State crackdown to remove writing implements from prisoners -
The State has already attempted to limit media contact with death row prisoners after the beating death by 9 guards of death row prisoner Frank Valdez in July, 1999.   Now the state attempts - without warning- to remove writing implements to make legal work and communication with the outside world difficult if not impossible.   Protest NOW !

"  Nov 25, 1999 -  Dear Tracy & Dave ...  I am writing to inform you that currently Florida Death Row are facing an immediate crisis.  Yesterday, Administration here at Union Correctional Institutions NorthEast Unit issued a memo.  The contents of that memo is as follows :  'Effective Monday November 29, 1999 standard Ink Pens and Pencils are now considered contraband.  A new security ink pen will be issued to each inmate.  These will be replaced on an as needed exchange basis only.  Also paperclips and staples will no longer be allowed in confinement areas.  This will mean that drawing pencils or calligraphy pens are no longer authorized.  I encourage all inmates to send these items to the property room to be mailed out.  This is a security enhancement which has been implemented in all confinement areas.  You will be given sufficient time to dispose of these items.  I appreciate your cooperation in this matter.'  Its signed. R.B Branham - Captain.  This violates their own Florida Administration Code, Chapter 33-3 which states...(mind you this is not a direct quote but close enough): Administration Confinement is not a disciplinary action and as such all on Administration Confinement are to be afforded the same or similar priveledges and programs as inmates in general population.   This security enhancement, I would guess, was implemented for those on Close Management Confinement which is a disciplinary action.  There is no reason for death row to be included in this category  and to do so is a gross misuse of their Administrative Powers.  To do so under the guise of security is wrong and exemplifies the arbitrary and capriciousness of this Governors Administrative policy making.  I would ask that you please move quickly on this as the longer one waits the  more harder it will be for us to reverse this problem. Also, anyone or groups you know of that may be of  assistance if you would contact them and relay this information please do so.  This rule would basically stop most art work we do.  Take care and be well. "A memo from the captain was passed out to everyone Wednesday to the effect that they'll be passing out 1 "security ink pen" to each prisoner in confinement, which means us, & all other pens & pencils will be considered contraband to be confiscated thereafter. It goes into effect Monday (this past monday) This current order comes from Moore, the Secretary of D.O.C. appointed by Jeb Bush. This took us by surprise because no rumors were floated; so it's rather a shock.....it's probably do-able since it's a so called "security matter".....Some of us are going to fight it of course, by filing various grievances; especially in regard to the fact that the memo was passed out on 11/24 when no mail would go out for the entire 4 day holiday weekend, and they would come & take our pens & pencils before we have any opportunity to protest......It's technically a violation of due process. The D.O.C. is supposed to circulate any proposed rule & allow a hearing on the merits of the issue with plenty of time before anything is enacted. Needless to say, we never heard or saw squat; so hope to get it thrown out due to that........There's also the precedent that we've been allowed pens & pencils for many years & there hasn't been any security violation utilizing such, that I know of, back here on the row.....Therefore, our best best bet is to argue that these crappy security pens will limit our access to the courts due to the fact that the security pens will only write for a page or 2. (so we've been told by the guys that have had to use such) The memo states that the pens will be traded for new ones on an as needed basis, but
can you imagine how tired the guards will be of doling them out? I'd need  5 pens for just one 10 page letter; so that means a new one every hour or so! That could lead to them trying to limit the length of our letters, say two pages at the most, which is flagrantly a violation of the constitution & freedom of speech (as is taking pencils & denying us the ability to create art!) ....Some of us figure that the best bet is for free people to write, call or e-mail to protest. "
