Emanuel Johnson - Innocent on Florida's Death Row
-35 year old, Black male, born in Mississippi
-one of six children to a young single mother
-experienced extreme poverty and racism as a child
-started working and stealing as young as 12 to support his family
-continued working and robbing empty houses as an adult
October 1988:
-arrested
and charged with 7 unsolved crimes
(some charges were dropped)
-police
violated his rights by not following proper procedure
during the arrest (illegal arrest)
1st Case :
" A 72 year old white female
was raped, robbed, and murdered. Ten Negroid pubic and body hairs found
on her body, and on the sheet, between both thighs, were positively not
mine (results of F.B.I. Lab.). Prints found on a disarrayed stand next
to the victims body were positively not mine. A partial print from an outside
back window was mine. I was her friend and handyman for five years. A rape
kit, and nightgown worn by the victim was sent to the F.B.I Lab. by the
police and prosecutor. When the D.N.A. excluded me as a possible source,
the prosecutor dropped the "rape" element of the charges. They withheld
all the evidence which could be used in my favor, for over a year, until
after a month of the trial. A biased judge refused to grant us more time
to prepare a defense based on these new discoveries."
2nd Case :
"The prosecution withheld, until
after a month of trials, police reports and evidence that someone else
committed the murder. A neighbor reported that two men ( one black and
one white) had committed the murder. Someone else reported that the black
guy had bragged about "icing" the victim. The police took bloody pants
from this Black man and sent them to the F.B.I Lab. prior to my arrest,
but the prosecutors asked the F.B.I. to stop testing the bloody pants after
my so-called
confession. The owner of the bloody
pants was the brother of a police officer...
3rd Case :
"In this case of attempted murder
the victim was guided to pick me.Three years after a strange Black man
had stabbed her, in the heart, in a 5 min. robbery, she swore I was the
man she picked out of a photo line-up nine months after the incident. She
identified me as the "Black Assailant" in the court room; I was the only
Black person in the court-room."
4th Case :
"In this case of attempted murder
the victim had picked someone else in a photo line-up months before my
arrest. This person was excluded when his prints did not match those taken
from and outside light-bulb which was unscrewed prior to the attack. My
prints did not match either. In the court-room the victim admitted
she was uncertain about identifying me as the attacker, but pointed to
me when asked if I was the attacker. Again I was the only Black person
in a full court-room."
In addition .
. .
. . . to these obvious miscarriages of justice there are many other facts that present a case of misconduct on the part of prosecutors, police, and the judge in Emanuel's case.
-the confession was obtained after hours
of interrogation by police officers who promised Emanuel that he would
do less time if he pled insanity and avoid being charged for the burglaries
he had committed -the judge is recorded on court transcripts planning to
meet a juror outside the courtroom
-court transcripts prove that police
and prosecutors lied on the stand
There is an overwhelming amount
of evidence to support Emanuel's claims of innocence and misconduct on
the part of the "justice" system. He could be executed in a little as 2
years if this is not resolved in his favor. Emanuel has not seen any of
his four children since 1991 and lives in a 9x9 cell 22 ½ hours
a day. He is only one of many who have been mistreated by the machine called
justice. Emanuel spends his time as a prisoner writing a book, writing
poetry, exercising, reading, and
meditating.
The state of Florida does provide
Emanuel with a state paid attorney but funds are required for hiring experts,
photocopying, stamps, etc. I think most of us are aware that in the "American
Justice" system you get what you pay for and being fundless and Black is
a disadvantage. Black men are being incarcerated at a much higher
rate that white men and are being treated as disposable people by our southern
neighbors. Anyone with any insight, advice, legal tips, a desire to help
with a letter
writing campain, or financial help
( even a few dollars for stamps; if sent directly to Emanuel there must
be no more than 20 American stamps per envelope and money orders must be
in American funds) please contact myself or Emanuel.
