Dear Sirs/Mesdames,
My name is Noel E Cain,
I live in Rockhampton, Queensland, Australia.
I am writing with a view
to obtaining support for the cause of one Anthony Charles Nealy, Prisoner
# 999289 at Polunsky Unit, Livingston, Texas.
Mr. Nealy is negroid,
born on 23rd March, 1964 the fourth child in a family of seven children.
Like many of his ilk, he is indigent, poorly educated and without means
of defending himself against the mammoth resources of the State. He was
convicted and sentenced to death on 1st
September, 1998 at Dallas
Texas for murder/robbery of one Jiten Vallabhbhai Bhakta at Dallas
on 20th August, 1997. The deceased was 25 years of age at the time of his
death and Mr. Nealy was 33 years of age.
According to Mr. Nealy
he did not commit the offence for which he was convicted and sentenced
to death. At the Grand Jury hearing at Dallas County police
evidence was not consistent with a written statement provided to them (the
police) by Mr. Nealy. Since that time, Mr. Nealy has been provided
with ineffective legal representation in violation of Strickland v
Washington, 466 US 668
(1984). Also in the subsequent trial of Mr. Nealy violations of Batson
v Kentucky, 476 US 79 (1986) occurred in that the defence actually colluded
with the prosecution to stack the jury with non-negroid jurors. All
this then amounts to Mr. Nealy being denied his rights under Amendments
Six, Fourteen and Five of the Constitution of the United States of
America.
How can any elected authority in this day and age justify putting anyone to death under such spurious circumstances. The death penalty in itself is an abomination and has no place in modern enlightened society. To impose this attrocity under the circumstances prevalent in the instant case is completely unacceptable.
The facts are there outlined
in documentation from the case for any interested party to see. They
cannot be disputed. It is blatantly obvious that overzealousness, racism
and downright criminal intent is present in the police investigation and
subsequent prosecution of the
unfortunate Mr. Nealy.

Now is the time to put this thing right. I urge the reader to do all to see that the authorities are enlightened to the injustice experienced in this case and urged to rectify the matter as a matter of urgency. Of course this is not the only case that need s similar attention in the United States of America. I am afraid that history will deal harshly with the United States of America with respect to this death penalty epoch.
