INFORMATION PROVIDED BY BILL KUENZEL AND HIS SUPPORTERS
Hello, my name is Bill. I am a 37 year old white male, 5'61/2,
140 pounds. Brown hair, brown eyes - divorced. I have a 15
year old who is the light of my life, my heart and soul, my pride and joy.
We do maintain a close relationship despite my being here.
I am an innocent man on Alabama death row since 1988. I was wrongly convicted, inadequetly represented. But now, if ever given a chance at a new trial, I believe I would be freed.
Here is a few examples which led to my conviction:
1. At the time of my arrest I was 25 and co defendant was 18.
2. I was given a court appointed attorney who spent a total of 4 1/2 hours with me prior, and 3 hours investigating my case. he was paid $ 1,500 while the State spent close to 75, 000 to convict.
3. The county in which I was tried had a population of 35, 000 and have 17 people on Death Row, including 2 women.
4. At least 6 witnesses placed the co defendant at the scene, 2 of which I knew. They described the second person as some one else not matching me. One person said they could not tell. If the passenger was was white or black, male or female. But 2 did say the codefendant talked to them and they knew his car. One person did testify I was home 35 miles away, also one other was willing to testify but my attorney would not call her.
5. The codefendant gave several different statements, none of which implicated me, until the state told him if he did not, he would be given a death sentence. But it said I was with him, he would be given a life sentence. He only served 8 years and is now free.
6. It was proven at trial he had blood on his clothes from the victim my clothes were tested, no blood found.
7. A
witness was interviewed by police, she said the co defendant was at her
home at 10:20 - 10:30 pm 20 miles from the crime scene. My home was
another 15 miles away. The crime occurred between 11:02-11:10 pm.
I was seen at my home between 10:45-11:00 pm asleep. (My attorney
was not told about the girl.)
In order for
me to have even had a chance to be involved, my codefendant would have
to have drove 15 miles from his girlfriends to my house. There is
a total of 40 miles in less than 20 - 25 minutes.
8. However, he was seen at the scene at 10:50 pm.
9. The codefendant testified he was never in the store. Asked how blood got on his clothes. The state answered for him by saying it came off the gun after the crime. However, the states own expert witness said the gun had no blood on it, had not been cleaned, and was not even sure if the weapon introduced was the murder weapon only it was the same gauge.
10. Now one witness a 18 year old girl, said she was a passenger in a truck (with the drivers side facing the store) moving at about 35-40 miles an hour on a rainy night. She said she looked in the door (tinted glass) seen two people inside with ski masks on. She knew it was me and the codefendant because she seen his car (the codefendant said no one wore a ski mask ) yet she waited 3 days before she talked to police.
11. My attorney asked nothing, would not allow me to call any witness who would or could help me. I was found guilty of a crime I did not commit for several years, I had lost hope as I could not find any one to take my case and I could not afford the fees.
In 1993 a very kind and good attorney from New York took my case pro bono. Due to his tireless effort, belief in my innocence, many hours of investigatingwe have proof of manufactured evidence, prosecutor misconduct, incompetent representation.
Alabama law says a person can not be convicted solely on accomplice testimony yet that is what has happened to me.
Now, the state says I was late filing an appeal so I am not entitled to it. This law is unclear, and without this hearing I could be barred from presenting new evidence.
There are many more issues.
BILL'S PENPAL REQUEST
I would be pleased to share, would welcome any advice, help, or thoughts. As well as a friendship. I only have my friendship to offer. I am well travelled, I enjoy music of all kinds (except rap), reading, long talks, as I am very open minded.
I am locked in a 5x9 cell 23 hours a day, taken away from those I love and adore for no reason. I am open, honest, easy going. I have written some poetry, a couple of which was published in England.
I believe writing is a form of exposing ones true self. While some say writing is a dying art, for someone in my situation I believe it is time to revive the art, maybe my right to life as well.
It is said the eyes are the window to the soul, well words are the gateway to the heart, words that are shared between friends allow us to open our hearts. When two people are true friends they can feel each others happiness as well as sadness. This should be shared openly and honestly, as friendship / relationships can only be built on a Foundation of Trust, Faith and honesty because sincerity can only come from within and we all need that someone to share our dreams, hopes, desires, and fears with.
Life is too short and uncertain to travel through life alone and our time is much more valuable if we invest it in others. I have a theory that each time a new friendship / relationship is formed we become a better person.
If you are interested in a true friend please contact me by mail. A friend is waiting.
