TALLAHASSEE - Governor Jeb Bush has temporarily stayed the
execution of Amos King to allow for
additional DNA
testing of evidence in this case. King’s execution had been scheduled
to take place
at 6:00pm today.
It is anticipated the additional DNA testing can be completed within the
next thirty days.
“Carrying out Florida’s death penalty law is one of the most serious
responsibilities I have as Governor.
Today a representative
from the Innocence Project, Barry Scheck, informed my legal office of the
existence
of previously
untested evidence and further DNA testing that could possibly exonerate Amos
King.
It is wholly appropriate
that we delay the execution until we can determine that all potentially useful
DNA testing has
been completed,” said Governor Bush.

be a hearing on the motions filed Friday evening by Amos King's attorneys
at 10am Sunday morning
(December 1,
2002) at the Pinellas County Criminal Justice Center on 49th St. in Clearwater,
Florida.

In my attorney's (Cole) closing statement, he conceded to the state's
case,
saying that: " I was guilty and stupid!

Amos King's Last Scheduled Execution Date and Time: 1/24/02 7:00 AM
Amos King of Florida is scheduled to be executed Jan. 24 for the 1976 murder of Natalie Brady. In the quarter century since the murder, King's death sentence has been argued before the United States Supreme Court, vacated, retried, and reinstated. On remand from the Supreme Court, an appeals court found that he had received ineffective counsel at trial and a new trial was ordered.
King's case challenges
most arguments in favor of the death penalty, and it highlights
the specific burden death
penalty states carry throughout an extended appeals process.
During his first sentencing
phase, King's legal counsel failed to object to the circumstantial nature
of the prosecution's case. In vacating his sentence, Judge Roney of the
Eleventh
Circuit Court of Appeals
noted, "King was convicted on circumstantial evidence which
however strong leaves room
for doubt that a skilled attorney might raise to a sufficient
level that, though not enough
to defeat conviction, might convince a jury that the ultimate
penalty should not be exacted."
In the 25 years since the crime, nothing has changed
significantly enough to
warrant the death penalty in his case.
The State of Florida has
been burdened for 25 years with determining punishment for
Amos King. Had the death
penalty not been an option, Amos King would have been
sentenced to life in prison
and the victims of this crime could have moved on. Instead,
King has been involved in
costly appeals and retrials due solely to his death sentence.
Contact Gov. Bush and ask
that he use Florida's resources effectively instead of wasting
them on the death penalty.

Because the Governor has signed a death warrant for the
execution of Amos Lee King, Jr. at 6:00 p.m. Thursday,
January 24, 2002, we direct that all further proceedings in this case
be expedited. We hereby set oral argument for 9:00
a.m. Tuesday, January 15, 2002, to hear any proceedings that may come
before this Court. A maximum of twenty (20) minutes to the side will be allowed
for the argument. The initial brief on the merits
shall be served on or before 12:00 noon Friday, January 4, 2002; the answer brief on the merits shall be served on or before
4:00 p.m.
Wednesday, January 9, 2002;
and the reply brief on the merits shall be served on
or before 5:00 p.m. Friday, January 11, 2002.

Spalding who was the Director of CCR for years and Petitioners' attorney
for years
told
his policy to the Gainesville Sun, Friday July 5th, 1996. "Most of those cases were very
poorly
tried at the trial level," Spalding says, "The question is how do you unravel it...it is so
screwed
up. If you sign a (death) warrant defense attorneys may come up with
something
that
gives the guy a new trial. If he gets a new trial at this stage,
he may walk because it has
been
so long. So you just kind of pretend it is not there."
