On July 18, 2002, the CCADP filed a complaint in the Arizona courts.
We are suing to have the law that attempts to cut off communication between advocacy groups and prisoners declared unconstitutional.

The ACLU is representing the CCADP and two other plaintiffs Citizens United for Alternatives to the Death Penalty and Stop Prisoner Rape in this action.

WHY WOULD ARIZONA RESORT TO SUCH DRASTIC MEASURES ?

There was a serious controversy several years ago surrounding Beau Greene's pen pal request on a commercial pen pal website.

As a result of pressure put on local Arizona politicians by Stardust Johnson
the victim's wife in this case, the State of Arizona passed legislation (HB 2376) that deprives prisoners, human rights and advocacy groups like the CCADP
of their First Amendment rights under the U.S. Constitution.

        WHY DID CCADP PUT ARIZONA'S DEATH ROW ONLINE ?
  The CCADP's Directors Dave Parkinson and Tracy Lamourie write on why the CCADP maintains prisoner webpages.

The Conditions in which prisoners are housed at Arizona's SMU II are widely documented.
Deprivation and extreme isolation that deprives many prisoners of not just their sanity but the very will to live, causing many to give up their appeals and seek death over life at SMU II.

The CCADP is not prison babes.net or some other for profit pen pal service, we are a not
for profit organization, all the work is volunteer - no one gets paid for the work we do.

This is not about 'Crime and Punishment" or about "Justice" as many would have you believe,
this is about state sanctioned murder, an international human rights issue simply and plainly.
We provide a forum by which the citizens of the US (and international observers) can see the men and women the United States Government (and others represented on our pages) are putting to death.

For those who would advise international observers such as ourselves not to meddle in domestic affairs - the effect of this legislation is an international issue.  There are currently six foreign nationals detained on death row in Arizona, none of whom were allowed their Vienna Conventions Rights to Consular Assistance before trial. This is a serious violation of international law that Arizona has already been condemned for at the International Court of Justice in the Hague regarding the execution of the LeGrand brothers from Germany in 1999.  ( See: LAGRAND CASE  (GERMANY v. UNITED STATES OF AMERICA )

In other states, Florida, Texas, Illinois and Pennsylvania in the past we have highlighted issues of abuses taking place against prisoners, in direct violation of DOC regulations. Names of Staff are mentioned, times, dates, etc... detailing abuses taking place...

This is the sort of thing we try to show the world, the plight of these individuals who are condemned to die and subject to horrendous circumstances daily.  Why are state officials so eager to cover up what
goes on in these 'Death Camps'  like Arizona's SMUII isolation / deprivation / torture unit - not to mention the legal issues in so many of the cases that contribute to these people being sentenced to death in the first place.

                                            ISSUES OF INNOCENCE...

Although we provide this service for all condemned men and women who write us, one of the most important aspects of our work is empowering individuals who feel they have been wrongfully convicted to have a chance to communicate this with the outside world.  Lacking any proper funds for a real legal team capable of overturning a capital case, in many instances we (and others like CUADPECADP, etc...) are the ONLY means by which the prisoner can garner assistance, whether it be moral, legal or financial support to try and save their lives.  ( See: Exonerated / Re-Sentenced Prisoners Released From Death Row  )

Regardless of guilt or innocence issues - These people are all going to die at the hand of the government and so it is not just our right, but our responsibility to ensure that the American public and international observers can read their words, see their faces and hear their cries before they are silenced by a barbaric and outdated practice known as 'capital punishment'.

This is not a crime and punishment issue, this is a human rights issue - we don't do pages for lifers,
or other prisoners who are not facing execution... If these individuals were not sentenced to death, the
victims family members and friends  would not be bothered by any of this, and these prisoners would
not have the attention of the international community (groups like ours, and also the European Union,
The Vatican, Amnesty international etc.,).

If they are or have been under sentence of death we will provide them a forum until the time comes for the state to murder them.  If they are executed, their webpages remain online as a memorial to the person, and as a permanent record of the state murder of that individual.  (See: Memoriam Pages 1 - 5 )

And as far as Arizona - there are many issues of concern, whether in individual cases - juveniles sentenced to death, foreign nationals, allegations that homophobia contributed to a death sentence; one case where his original defense lawyers has since become prosecutor and is now seeking his death; cases of mental illness; as well as the general conditions at SMU II, and prisoners who claim issues in their cases. All of this the state has an interest in keeping quiet.  ( See:  Arizona Death Row Prisoner Pages )

None of this would ever have happened had this bill not been made law.

When we first heard about HB 2376 near the end of 1999, before the legislation was passed,
we had less than a dozen pages/pen pal requests for Arizona prisoners.

As a result of hearing such laws were in the making we purposely had our members contact all
Arizona death row prisoners to let them know of our free services to ensure those who wished to,
could be heard.  We received about 40 responses back, and those became the pages / pen pal
requests we had on our site.

Since the enforcement of this law in May/June 2002 we have begun to make at least informational / compilation webpages or pen pal requests for all the prisoners on death row in Arizona and we will
be encouraging our members to contact all these prisoners who may not have been in touch with abolitionist groups/prison support groups, and to make them aware of the actions being taken.

Arizona prisoners who we've heard from fully endorse the actions the CCADP has
taken to uphold their rights to be heard, and have congratulated us on this action.

Below are some comments by death row prisoners in other states who we maintain webpages for, giving their reasons why the CCADP's work is so crucial that HB 2376 must be challenged and defeated as soon as possible.

FROM A TEXAS DEATH ROW PRISONER:
"And I want to thank you.  I do not dramatize or exaggerate when I tell you I believe you have served as a conduit that saved my life. In the despair that can overwhelm us here, I was  very seriously considering suicide or waiving my appeals.  Because of you I have found reason for fighting, reason for living, and happiness beyond measure... My cellie at the Ellis Unit was going to submit his pen pal ad to you and suggested I 'ride with him in the envelope he mailed.  I didn't think anyone would want to write me and so I jotted the goofy little message you still have posted, thinking nothing would come of it, but the response has blown me away and changed my life tremendously.  I feel like I can say that I know you must have been informed of how horribly the conditions at Texas death row have deteriorated, and because of these conditions I do not believe I would have otherwise been able to stand these last few years.  Thank you for giving me legs, a person whose country has decided to kick off the planet. Actually, no what they propose to do is worse than that because that implies life on another planet or something.  You didn't even know me!!!  That's what blows me away the most."

FROM A NEW JERSEY DEATH ROW PRISONER:
"Your site has changed my life, it taught me to love to write, except when it gets over 100 degrees in my tiny cell.  But it helped me hang on to life, most times while on death row I wanted to give up and die, not
only cause someone was gone because of me or cause I lost everything.  But I felt like I was worthless. I never felt that way before and didn't know how to accept it.  But I prayed and cried every single night, and
my prayers were finally answered, I was blessed with another chance, and a beautiful woman who loves me and I love her.........Thank you for letting _______ look for me and find me, A good thing has just happened. Thank you Tracy and Dave,"

"I can't thank you enough, I've found both my sons only because of your webpage you put up for me....
I received many letters from people willing to help me in my search...thank you again for all your help.  The difference you're making in our life on death row, is more than can be put in writing. Thank you."
